1. Services Provided

The Turd Burglar provides portable toilet and handwash station rental services for construction sites, special events, and other temporary needs in the Ham Lake and northern Twin Cities metro area.

Our services include:

• Delivery and pickup of rental units
• Clean, well-maintained portable restrooms
• Handicapped accessible units
• Handwash stations

2. Service Area

We primarily serve Ham Lake, MN and the surrounding northern Twin Cities communities, including but not limited to Andover, Blaine, Circle Pines, Coon Rapids, Forest Lake, and Hugo. Service availability outside these areas may vary and should be confirmed when requesting a quote.

3. Quotes and Pricing

All quotes provided are estimates based on the information you provide. Final pricing may vary depending on:

• Rental duration
• Delivery location and accessibility
• Type and number of units requested
• Additional services required

Quotes are valid for 30 days from the date provided unless otherwise specified.

4. Rental Period and Use

The rental period begins on the date of delivery and ends on the scheduled pickup date. You agree to:

• Use rental units only for their intended purpose
• Not relocate units without prior authorization
• Ensure units are accessible for delivery and pickup
• Keep units on level ground and away from hazards
• Not dispose of inappropriate materials (hazardous waste, chemicals, etc.)

5. Customer Responsibilities

As the customer, you are responsible for:

• Providing accurate delivery address and site access information
• Ensuring adequate space for delivery and placement
• Obtaining any necessary permits or permissions for unit placement
• Securing the rental site and units from theft or vandalism
• Notifying us immediately of any damage or service issues

6. Delivery and Pickup

We will make reasonable efforts to deliver and pick up units at the scheduled times. However, delivery and pickup times may vary due to weather, traffic, or other unforeseen circumstances. We are not liable for delays beyond our reasonable control.

7. Unit Condition and Maintenance

All units are delivered clean and in good working condition. We maintain our units to the highest standards. If you experience any issues with your rental unit during the rental period, please contact us immediately so we can address the problem.

8. Damage and Loss

You are responsible for any damage to rental units beyond normal wear and tear, including but not limited to:

• Vandalism or graffiti
• Theft of units or components
• Fire or structural damage
• Damage from improper use or placement

Repair or replacement costs for damaged or lost units will be charged to the customer.

9. Prohibited Uses

Rental units may not be used for:

• Disposal of hazardous materials, chemicals, or medical waste
• Any illegal activities
• Permanent or semi-permanent installations without prior agreement
• Any purpose that could damage the unit or create unsafe conditions

10. Limitation of Liability

The Turd Burglar shall not be liable for any indirect, incidental, special, or consequential damages arising from the rental or use of our units. Our total liability shall not exceed the total amount paid for the rental.

We are not responsible for:

• Injuries resulting from improper use of rental units
• Damage to property caused by customer placement or use
• Issues arising from inadequate site access or preparation

11. Weather and Force Majeure

We are not liable for delays or inability to perform services due to circumstances beyond our control, including but not limited to severe weather, natural disasters, labor disputes, or government restrictions.

12. Indemnification

You agree to indemnify and hold harmless The Turd Burglar from any claims, damages, losses, or expenses (including legal fees) arising from your use of the rental units or violation of these terms.

13. Satisfaction Guarantee

We stand behind our 100% satisfaction guarantee. If you are not satisfied with our service or the condition of your rental unit, please contact us immediately so we can make it right.

14. Modifications to Terms

We reserve the right to modify these Terms & Conditions at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.

15. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Anoka County, Minnesota.

16. Severability

If any provision of these Terms & Conditions is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining terms remain in full force and effect.

17. Entire Agreement

These Terms & Conditions, together with our Privacy Policy, constitute the entire agreement between you and The Turd Burglar regarding the use of our services and supersede all prior agreements and understandings.
